What VettED found on the public policy — exactly what would need to clear before approval:

Not addressed — gap Q8 · Data Rights
Do the student / educator / parent / school retain ownership of data and IP of uploaded content?
Policy does not explicitly address student/educator/parent/school ownership of uploaded content or IP
Disqualifying — vendor does this Q11 · Data Safety
Can students contact or interact with UNKNOWN users (strangers / the general public) in environments NOT supervised by a teacher or school? (Teacher-managed or within-class interaction, and content-only sharing, do NOT count.)
“If you use Portfolium, examples of sharing your personal information may occur when you: Create an account, your name and other profile information will be viewable and searchable by other users and Employer Partners. Post content to Portfolium, such as videos, photos, school projects, and comments, which are displayed”
Heads-up: Instructure has announced Portfolium’s retirement (by Dec 2026) — portfolios move natively into Canvas. The current policy still carries this language, so it stands today, but it’s on the way out. If your schools don’t use Portfolium, waive it below.
Not addressed — gap Q16 · AI & Model-Training
Does the vendor use student/user data — including uploaded content — to train, fine-tune, or improve AI/ML models?
Policy does not address whether student/user data is used to train, fine-tune, or improve AI/ML models. References AI tools but does not disclose training practices.
Doesn’t apply to your schools? Tick what to waive, then re-score. (e.g. you don’t enable Portfolium. Each waiver is logged as a cited footnote — never silent.)
